This License Agreement outlines how clients may use music created by Hexcellence Music Productions (“Hexcellence”).
1. Ownership
All music, lyrics, audio, and related creative content produced by Hexcellence Music Productions remain the sole intellectual property of Hexcellence, unless explicitly transferred in writing.
When purchasing a Hexus, clients receive a license to use the music, not ownership of the underlying copyright.
2. License Types
Personal Use License
Clients may:
Listen to the music privately
Share with friends and family
Post on personal, non-monetized social media
Use for personal events and memories
Clients may NOT:
Sell, resell, or redistribute the music
Upload to streaming platforms as their own work
Use for business, advertising, or monetized content
Commercial Use License
Clients may:
Use the music for business promotion and branding
Use in social media content (including monetized content)
Use in advertising and marketing
Clients may NOT:
Resell, sublicense, or distribute the music as a standalone product
Claim ownership or authorship
Transfer the license to another individual or business
Exclusive License (If Purchased Separately)
Clients may:
Use the music for any personal or commercial purpose
Monetize across platforms
Distribute on streaming platforms
Modify or adapt the music
Important:
The track will no longer be licensed to new clients after purchase
Previous licenses (if any) remain valid
Ownership transfers only if explicitly stated in writing
3. Producer & Songwriter Rights (Royalties & Credits)
Unless explicitly agreed otherwise in writing:
Hexcellence retains all producer and/or songwriter credits
Hexcellence retains all rights to publishing, royalties, and performance income
This includes, but is not limited to:
Streaming royalties
Performance royalties
Digital monetization (YouTube, etc.)
Requests for:
Full ownership
Royalty-free buyout
Removal of credits
Must be negotiated separately and require a significantly higher fee, confirmed in writing.
4. Modifications
Clients may not alter, remix, resell, or create derivative works from Hexcellence music without written permission, unless permitted under an Exclusive License.
5. Portfolio Rights
Hexcellence Music Productions reserves the right to use completed work for promotional purposes, including:
Website examples
Social media
Portfolio showcases
Client identity will only be shared with permission.
6. Refunds & Payment Finality
All purchases are subject to the Hexcellence Music Productions Refund Policy.
Due to the digital and custom nature of the work:
Payments are final once production begins or files are delivered
No refunds will be issued based on dissatisfaction after delivery
7. Prohibited Uses
Clients may NOT:
Resell, sublicense, or redistribute the music
Claim ownership or authorship
Use the music in unlawful, harmful, or misleading content
Mint or sell the music as NFTs or digital assets
8. Termination
This license may be terminated if the client violates any terms.
Upon termination, all usage rights are revoked immediately.
9. Limitation of Liability
Hexcellence Music Productions is not liable for:
Third-party platform actions (copyright claims, removals, etc.)
Indirect or consequential damages
Business outcomes related to use of the music
10. Governing Law
This Agreement shall be governed by the laws of the State of California.
